Q:        What is the Ohio Sentencing Commission?

A:        Trial court judges decide specific consequences in each case from the options made available by the law. Minimum and maximum incarceration, a range of possible fines, mandatory prison offenses, and the length of probation are all set by statute.

To assist the legislature, Ohio law created the Ohio Sentencing Commission, which reviews statewide and national trends, effectiveness of sentences, and available resources, and makes recommendations for changes in sentencing law. The Commission is made up of the Chief Justice, one Court of Appeals judge, three municipal or county judges; three juvenile court judges; and three other common pleas judges, a county prosecutor, juvenile prosecutor, a municipal prosecutor; two defense attorneys; a Bar Association representative; a sheriff; two police chiefs; a crime victim; a county commissioner; a mayor, a senator and a state representative from each political party, the State Public Defender, Director of Rehabilitation and Correction, Director of Youth Services, and Superintendent of the Highway Patrol.
